|Minimum Qualifications||NYS employee with one year or more of permanent or contingent-permanent competitive service as a Senior Attorney (G25) Hearing Officer (G25), Motor Vehicle Referee (G25), Senior Insurance Policy Examiner (G25) or Unemployment Insurance Referee (G25); OR a NYS employee with one year or more of permanent or contingent-permanent competitive service in a title at SG-23 or above and eligible for transfer under Sections 70.4 or 52.6 of the Civil Service Law. (Candidates requesting consideration for transfer under Section 70.4 or 52.6 of the Civil Service Law must also be a graduate of an accredited law school with an LLB or JD degree, and may also need to meet additional conditions to qualify for consideration.)|
|Preferred Qualifications||Admission to the New York State Bar and a member in good standing with (1) or more years of post-Bar legal experience in bankruptcy proceedings. Experience with not-for-profit institutions, health law, and financial transactions would be helpful.|
|Responsibilities||Under the supervision of the Director of House Counsel, the selected candidate would be responsible for Assessing the legal situation of health care providers whose financial situation raises issues of potential bankruptcy, failure to pay creditors, failure to pay staff; Providing an analysis of likely bankruptcy court scenarios and various options available to the Department if it were to make funds available through grants/contracts/payment to the troubled provider; and the consequences of such grants /contracts in a bankruptcy proceeding; Implementing strategies or options related to aiding fiscally troubled institutions; Reviewing certificate of need applications submitted by various types of providers and establishing contingencies with respect to such applications; Drafting legislation related to the Department's role with respect to fiscally troubled providers and work on possible regulatory changes; Producing comments on bills and pending legislation dealing with Departmental issues; Providing on-going advice to programs on a variety of fiscal and operational issues involving the health care industry; Collaborating as needed with other bureaus In the Office of Counsel as they address legal issues related to bankruptcy, nonpayment of monies owed, etc.; Attending meetings and conference calls on industry issues and other assignments in support of the Department's Division of Legal affairs as assigned.|
