The following summarizes recent statutory changes made to the Residential Health Care Facility (RHCF) Cash Receipts Assessment Program. Section 37 of Part C of Chapter 58 of the Laws of 2007 extended the current 6% assessment rate through March 31, 2011. The chapter law amendment to Section 2807-d (2)(b)(vi) of the public health Law reads as follows: " for all such gross receipts received on or after April 1, 2003, through March 31, 2005, such assessment shall be five percent and further provided that for all such gross receipts received on or after April 1, 2005, through March 31, 2009 and on or after April 1, 2009 through March 31, 2011 such assessment shall be six percent."

Until receipt of further notice from the Department, providers should continue filing monthly reports and payments based upon the existing 6% assessment rate. An updated Monthly Cash Receipts Assessment Report Certification Form, Assessment Report, and Filing Schedule are enclosed for your information.
