Dear Administrator/Controller:

Re: Residential Health Care Facility (RHCF) Cash Receipts Assessment Program

This is to provide notice of the Department's implementation plan regarding enacted modifications to the subject assessment program. These statutory changes to Section 2807-d of the Public Health Law (PHL) were summarized in my letter dated May 13, 2005 (copy enclosed). At that time, you were advised to continue filing reports and payments for report months on and after April 2005 at the existing 5% assessment rate pending further notification from the Department.

This deferral was implemented to allow the State sufficient time to secure federal approval of Medicaid RHCF rate increases reflecting reimbursement of the Medicaid share of the newly authorized 6% assessment. This federal approval was obtained on September 29, 2005. Rates reflecting this increase will be processed for payment by December 15, 2005, for dates of service on and after April 1, 2005.

To allow for provider receipt of the above referenced corresponding Medicaid rate adjustments,

Under separate cover, you will receive revised reporting forms and instructions reflecting the 6% assessment for the November report month and required retroactive adjustments for the April through October 2005 period.
