Letter to Administrator/Controller regarding Health Facility Cash Assessment Program

Dear Administrator/Controller:

This letter provides notice of statutory changes that will reinstate the New York State Health Facility Cash Assessment Program (HFCAP) as part of the enacted 2009-2010 State Fiscal Year Budget.

A .35% Health Facility Cash Receipts Assessment will be applicable to cash received for periods on and after April 1, 2009, for the following provider types:

  • All Article 28 general hospitals
  • All Article 36 certified home health agencies
  • All Article 36 long term home health care programs
  • All personal care service providers, both licensed and exempt agencies, possessing a Title XIX (i.e., Medicaid) contract with a Local Social Services district for the delivery of personnel care services pursuant to the NYS Social Services Law.

Please note that a separate monthly cash assessment report must be filed for each of the above noted service categories, even if there were no assessable cash receipts for the reporting month. The applicable reports and instructions will segregate each provider class separately for filing purposes.

All providers will be required to submit their Health Facility Cash Receipts Assessment reports electronically through a website application that will be available by April 30, 2009 at www.hcrapools.org. To file electronically, you must first establish an electronic filing account with the Office of Pool Administration (OPA) and be assigned a secure User ID and password. You cannot access the web application to electronically file and/or electronically sign the report until you have both a User ID and Password.

The Department will also send detailed instructions for each of the referenced provider classifications. These instructions should be followed carefully since they will provide more explicit directives on cash receipts which are affected by the assessment.
