SUBJECT: Continuous Agreements with Day Care Home Providers

I. Purpose and Scope

The purpose of this memorandum is to remind Sponsoring Organizations of Day Care Homes of the requirement to obtain and submit Continuous Application and Agreement forms (CACFP-3705) for all day care home providers actively participating in the Child and Adult Care Food Program (CACFP). As of July 1, 2005, all providers claiming in CACFP were required to have the new CACFP-3705 form or the Application and Agreement Addendum (DOH-3705A) completed and on file.

II. Background Information

  1. The requirement to change to a continuous provider agreement was contained in the 2004 Reauthorization of Child Nutrition Programs, and was communicated to sponsors in memorandum DOH-CACFP 93 (08/04), Changes from the Child Nutrition and WIC Reauthorization Action of 2004. CACFP provided training to sponsors on implementing this change in September 2004 and reminded sponsors of the deadline at the June 2005 training. In addition, CACFP staff has notified sponsors if providers were missing these documents when July and August, 2005 claims were processed.

  2. A provider who is lacking an approved Continuous Agreement (DLH-3705) or Addendum (DOH-3705a) is ineligible to claim until the CACFP-3705 form for that provider is received and approved by CACFP. These providers are not payable and should not be included on the monthly claim.

  3. CACFP recommends that sponsors review their provider files against the Local Homes System to ensure that the Continuous Agreements/Addendums are present and that the database reflects this. Sponsors should submit claims that contain only eligible providers to avoid a delay in payment. Adjusted claims may be submitted within 90 days past the claiming month for providers when their missing CACFP-3705 forms are also submitted.

III. Summary of Changes

All CACFP sponsors of family day care homes must have a Continuous Application and Agreement form (CACFP-3705), or an Application and Agreement Addendum (DOH-3705A), on file for each provider on every claim. Sponsors should not include providers on their claim if their continuous agreements have not been received by CACFP for approval.
