Dear Administrator:

This letter provides you with information regarding your Residential Health Care Facility (RHCF) Medicaid reimbursement rates effective January 1, 2022. These rates have been promulgated in accordance with Article §2808 2-c of the Public Health Law.

The initial rates are provided on the new Health Commerce System (HCS) application (Healthcare Financial Data Gateway/2022 Initial Capital Rates) and include the following operating, capital, and non-capital components as well as the components of the Miscellaneous Per Diem Adjustment:

  1. Operating and Case Mix Components: The January 1, 2022 rates remain unchanged from the previously issued rates provided in the Departmental letter dated July 7, 2022.
  2. Capital Component: Reflects 2022 capital reimbursement rate that is based upon your facility’s 2020 certified cost report and reflects approved attestations received during the preview period. The capital component is also reduced by an overall five-percent cut in accordance with §2808-(2-b)(a)(iv) of the Public Health Law. This five-percent cut is reflected on line 13 of the rate sheets as part of the Miscellaneous Per Diem Adjustment.

Further information regarding the Initial 2022 Adult Day Health Care Program rates will be forthcoming. No updates to these rates are available at this time.

The Department’s regulations allow rate appeals to be filed within 120 days from the date of this letter. The deadline to file appeals pertaining to the January 1, 2022 rates is midnight, December 23, 2022. The payment will be made in cycle 2350, check release date September 21, 2022.
