Single Source Procurement: EmedNY

The NYS Department of Health (DOH) Office of Health Insurance Programs (OHIP), Division of Systems, requested and received a Contract Reporter Exemption Request to amend contract number C014305 with Computer Sciences Corporation (CSC) to extend the contract from March 1, 2016 through April 30, 2017.

Amendment No. 17 to the CSC contract extended the contract term for two years (March 1, 2014 through February 29, 2016). This period was broken into three phases to correspond with the then schedule for the design, development, implementation (DDI) and start of operations by the contractor selected as a result of the Medicaid Administrative services (MAS) procurement. The first phase was to cover the period March 1, 2014 through December 31, 2014 (ten months) and would be a continuation of all eMedNY responsibilities. Phase 2 was to cover the period January 1, 2015 through September 30, 2015 (nine months) and CSC's responsibilities would be reduced as the result of the implementation and start of operations of the planned first MAS phase. The third phase of CSC's contract extension would cover the period October 1, 2015 through February 29, 2016 (five months). During this final third phase CSC's responsibilities would be reduced to performing a claims run-out period as the MAS contractor would have assumed all other MMIS fiscal agent responsibilities.

The procurement and contracting process of the new contractor has encountered significant delays. Some delays were based upon Department decisions, e.g. lengthening the question and answer period and extending the due date for proposals. The election of the recommended contract awardee also resulted in two procurement protests that were not resolved until April 17, 2015. As a result, there is a need to extend CSC's eMedNY contract to provide continuing MMIS fiscal agent services until the new contractor has completed all DDI activities and has begun operations.

"MAS" was a working title used for the procurement, and upon completion of the procurement the title of "NYMMIS" (New York Medicaid Management Information System) was selected for the new system, and this is the name that will be used going forward. Since the NYMMIS contract is now fully executed and the selected contractor began work on May 1, 2015, the NYMMIS implementation schedule is as follows:

  • Phase 1: May 1, 2015 through January 31, 2016 (nine months)
    Phase 2: May 1, 2015 through October 31, 2016 (eighteen months)

This will result in all MMIS fiscal agent responsibilities, other than a claims run-out period and limited support, to be transitioned to the new NYMMIS contractor.

To accommodate this schedule, CSC's contract needs to be adjusted to maintain MMIS fiscal agent responsibilities, and the Department proposes the following schedule:

  • Phase 1: March 1, 2014 through December 31, 2014
    Phase 1A: January 1, 2015 through February 29, 2016
    Phase 2: March 1, 2016 through November 30, 2016
    Phase 3 (claims run-out): December 1, 2016 through April 30, 2017

Note that while Phase 1 has been lengthened by fourteen (14) months (through the addition of Phase 1A), the duration of the remaining phases remains unchanged. It is only the start date of these last two phases that is being delayed.

The proposed amendment will be a single source award. CSC is the incumbent and has the capability to perform the needed function for the necessary period of time. The Department cannot envision how any new contractor could economically replicate CSC's current infrastructure and capabilities that would be required for a relatively short period of time (an additional fourteen months) only then to be abandoned.
