Single Source Procurement: Family Planning - HIV Integration

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible.

The Bureau of Maternal and Child Health is requesting a waiver to add federal funding to select Family Planning contracts for the period 1/1/2014 – 12/31/2015. The additional funding is provided by a federal grant award from the Department of Health and Human Services, Office of Population Affairs (OPA), to support the integration of HIV Testing and Linkage to Care and Treatment in Family Planning Services Programs. Per OPA requirements, this funding opportunity was restricted to current contractors providing Family Planning services. The grant award funds will be allocated to the following family planning contract agencies: Community Healthcare Network, New York Presbyterian Hospital, Planned Parenthood Hudson Peconic, Inc., and Syracuse Model Neighborhood Facility, Inc.

DOH invited all fifty of the current family planning programs to submit proposals for funding to DOH, which submitted the grant application to OPA on their behalf. Four of the family planning contractors submitted proposals in response to this request. The four proposals were reviewed by DOH staff familiar with the HIV Integration program initiative and requirements. All four proposals were deemed acceptable and were included in the DOH application for funding based on the following factors:

  • The programs have received HIV integration funds since 2001;
  • The programs have well-established HIV testing and prevention programs;
  • The programs' proposals met the OPA funding opportunity criteria for funding – e.g. the services would be directed toward high-need communities/individuals, the services would include a combination of HIV testing and HIV prevention activities, the programs have well-established data collection and reporting systems

The proposed budgets in the federal grant application were approved by the Department of Health and Human Services, Office of Population Affairs (OPA), to support the integration of HIV Testing and Linkage to Care and Treatment in Family Planning Services Programs. OPA did not award the full amount requested, so the award amount for each contract was determined by equally proportioning the awarded funding based on the amount each program requested in their application.
