Dear Chief Executive Officer/Nursing Home Administrator:

The Department is planning to adopt the 2018 standards of the Facility Guidelines Institute (FGI). Pending approval of a proposed regulation codifying these changes, applications, including new construction and renovation received after September 1, 2019 may meet 2018 FGI and all its referenced standards as an equivalent to the existing requirement to meet the 2010 FGI specified in 10 NYCRR 711.2. As noted in prior guidance, projects currently submitted will be reviewed under the 2014 FGI guidelines, however, the 2018 edition of FGI can also be used for CON submissions prior to September 1, 2019 and will be reviewed as an equivalency until the regulations are enacted.

Copies of the 2018 FGI Guidelines can be obtained in digital or paperback format from MADCAD at fgi.madcap.com.

The Department will be updating its guidance for both drawing and waiver submissions. The updated guidance documents will be available on the Certificate of Need website at here.
