Single Source Procurement: New York State Abortion Access Program (NYSAAP) (Formerly known as Expanding Safe and Supportive Medical and/or Procedural Abortion Access Program (ESSMAA))

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health (DOH) is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. The New York State Office of the State Comptroller’s Bureau of Contracts on 02/16/2024 approved a request for exemption from giving notice in the New York State Contract Reporter for access to timely and quality medical and procedural abortion and a full range of reproductive health services to individuals seeking abortion services in NYS. The New York State Department of Health, Division of Family Health, Bureau of Perinatal, Reproductive, and Sexual Health Program made a determination to issue a Single Source Procurement to thirty-eight grantees to support the following project.

The New York State Abortion Training and Support Program (NYSAAP), formerly known as Expanding Safe and Supportive Medication/Procedural Abortion Access Program (ESSMAA), was established in 2022 following the Supreme Court Dobbs v. Jackson decision that overturned Roe v. Wade. Given restrictions on abortion in multiple states across the U.S., and an influx of patients seeking care in NYS, NYSAAP addresses patients’ reproductive health care needs by ensuring that abortion care is accessible to all.

Due to the specific circumstances of this procurement and the unique qualifications of the selected firms/entities, a competitive procurement was not feasible in this instance.
