Single Source Procurement: NY Enhanced Tuberculosis Control Testing Efforts
Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. The New York State Office of the State Comptroller’s Bureau of Contracts on 04/14/23 approved a request for exemption from giving notice in the New York State Contract Reporter for the expanded testing for Tuberculosis from Quest Diagnostics.
Due to the specific circumstances of this procurement and the unique qualifications of the selected firm/entity, a competitive procurement was not feasible in this instance. Quest is the only lab with a geographic presence that covers all of New York State that provides both Quantiferon TB Gold and T-Spot testing.
