Public Health and Health Planning Council

The Public Health and Health Planning Council (PHHPC) has a broad array of advisory and decision-making responsibilities with respect to New York State's public health and health care delivery system. It is charged with adopting and amending the Sanitary Code and health care facility, home care agency, and hospice operating regulations. The PHHPC also makes decisions concerning the establishment and transfer of ownership of health care facilities, home care agencies and hospice programs. It makes recommendations to the Commissioner of Health concerning major construction projects, service changes, and equipment acquisitions in health care facilities and home care agencies. It also advises the Commissioner on issues related to the preservation and improvement of public health. The Council's powers and duties are set forth in section 225 of the Public Health Law.

Responsible for reviewing the CON applications involving construction, service changes, establishment, and transfers of ownership. Reviews the establishment of fundraisers, corporate name changes, and changes in certificates of incorporation.

**Ad Hoc Committee on Freestanding Amblatory Sirgery Centers and Charity Care

The Committee is to examine the factors affecting the level of charity care being provided by freestanding ambulatory surgery centers (ASCs), including those that cause some ASC operators to fall significantly short of their charity care targets. The Committee is also to consider alternatives to the direct provision of charity care by freestanding ASCs which may nevertheless expand access to services by uninsured clients and others dependent on uncompensated care.

Committee on Codes, Regulations and Legislation

Reviews new and revised regulations relating to medical facility operational and structural standards, including quality of care and the need for the facilities and/or services. Reviews amendments to the State Sanitary Code and other matters referred by the Commissioner. The Codes Committee will also include work of the SHRPC's Fiscal Policy Committee which was charged to review proposed changes to part 86 of the State Hospital Code concerning reimbursement rates for medical facilities.

This meeting will focus on key opportunities to leverage current health systems reform and improvement initiatives to prevent maternal morbidity and mortality. It is part of a series of structured discussions convened by the Committee to advance three strategies from the state's Prevention Agenda:

  • integrate preconception care into routine health care for women of reproductive age;
  • assess and address pregnancy planning, including use of effective contraception to prevent unintended pregnancy, among women with serious chronic conditions or previous adverse pregnancy outcomes; and
  • implement comprehensive and coordinated protocols and systems for early identification and management of high-risk pregnancies.

Invited guest discussants from the Department of Health Office of Health Insurance Programs and Office of Quality & Patient Safety will highlight several current policy initiatives and identify opportunities to integrate the above strategies within these initiatives to improve services and outcomes for high-risk reproductive age women.

COMMITTEE ON HEALTH PLANNING

The Health Planning Committee advises the Council on need-methodologies, health facility plans, and emerging health care issues. Monitors major health care initiatives and advises the Council on progress and/or problems. The Committee will also include functions from the SHPRC's Committee on Major Medical Equipment and Appropriateness Review in the evaluation of high technology equipment, and specialized services such as organ transplants. The Committee will also take into consider rural health matters in collaboration with the Rural Health Council. The Committee will also handle matters formerly considered under the SHPRC's Information Systems Review Committee whose general purpose was to advance a framework for CON to ensure interoperable health information technology as an underpinning to health care delivery.
