Public Health and Health Planning Council

The Public Health and Health Planning Council (PHHPC) has a broad array of advisory and decision-making responsibilities with respect to New York State's public health and health care delivery system. It is charged with adopting and amending the Sanitary Code and health care facility, home care agency, and hospice operating regulations. The PHHPC also makes decisions concerning the establishment and transfer of ownership of health care facilities, home care agencies and hospice programs. It makes recommendations to the Commissioner of Health concerning major construction projects, service changes, and equipment acquisitions in health care facilities and home care agencies. It also advises the Commissioner on issues related to the preservation and improvement of public health. The Council's powers and duties are set forth in section 225 of the Public Health Law.

The Public Health Committee is charged with addressing the statewide governmental public health infrastructure (including workforce, IT, laboratory and other organizational capacity consistent with the Essential Public Health Functions) and support actions to assure readiness for future public health agency accreditation and public health workforce certification. The Committee also promotes interagency collaborations across government to support a "Health in All Policies" approach by State leadership.

Reviews new and revised regulations relating to medical facility operational and structural standards, including quality of care and the need for the facilities and/or services. Reviews amendments to the State Sanitary Code and other matters referred by the Commissioner. The Codes Committee will also include work of the SHRPC's Fiscal Policy Committee which was charged to review proposed changes to part 86 of the State Hospital Code concerning reimbursement rates for medical facilities.

The Health Planning Committee advises the Council on need-methodologies, health facility plans, and emerging health care issues. Monitors major health care initiatives and advises the Council on progress and/or problems. The Committee will also include functions from the SHPRC's Committee on Major Medical Equipment and Appropriateness Review in the evaluation of high technology equipment, and specialized services such as organ transplants. The Committee will also take into consider rural health matters in collaboration with the Rural Health Council. The Committee will also handle matters formerly considered under the SHPRC's Information Systems Review Committee whose general purpose was to advance a framework for CON to ensure interoperable health information technology as an underpinning to health care delivery.

The mission of this committee is to examine the current building, construction and physical plant codes for health care facilities in the wake of extreme weather experienced recently with Hurricanes Irene and Lee and Superstorm Sandy. This forum will be an opportunity to share the lessons learned and the research conducted by government agencies, health care providers, design professionals, major construction companies and understand its effects on consumers and the general public.

In May of 2013, the Department announced that there would be a moratorium on new construction and major renovation projects for health care facilities located in costal flood areas. The work of this committee will address what changes are needed and will build upon the work already done by NYC and FEMA.

The primary deliverable is a set of recommendations to be presented to the PHHPC for approval. Recommendations will include storm mitigation strategies and revisions to the current set of design and building codes that apply to health care facilities in NYS. The E&CS committee is expected to meet four times over the course of the summer of 2013 with the first meeting scheduled for June 7th. One of the goals of the June 7th meeting is to identify the specific land areas affected by the moratorium. This will provide assistance to providers to know if their facility (or their proposed facility) is affected.

Reviews new and revised regulations relating to medical facility operational and structural standards, including quality of care and the need for the facilities and/or services. Reviews amendments to the State Sanitary Code and other matters referred by the Commissioner. The Codes Committee will also include work of the SHRPC's Fiscal Policy Committee which was charged to review proposed changes to part 86 of the State Hospital Code concerning reimbursement rates for medical facilities.

The Committee will also take into consider rural health matters in collaboration with the Rural Health Council. The Committee will also handle matters formerly considered under the SHPRC's Information Systems Review Committee whose general purpose was to advance a framework for CON to ensure interoperable health information technology as an underpinning to health care delivery.

This meeting will convene immediately following the Committee on Establishment and Project Review.

The Public Health Committee is charged with addressing the statewide governmental public health infrastructure (including workforce, IT, laboratory and other organizational capacity consistent with the Essential Public Health Functions) and support actions to assure readiness for future public health agency accreditation and public health workforce certification. The Committee also promotes interagency collaborations across government to support a "Health in All Policies" approach by State leadership.

The Committee will convene immediately following the Committee on Codes, Regulations and Legislation.

COMMITTEE ON ESTABLISHMENT AND PROJECT REVIEW

Responsible for reviewing the CON applications involving construction, service changes, establishment, and transfers of ownership. Reviews the establishment of fundraisers, corporate name changes, and changes in certificates of incorporation.

The Committee will meet immediately following the Committee on Public Health.
