Public Health and Health Planning Council

The Public Health and Health Planning Council (PHHPC) has a broad array of advisory and decision-making responsibilities with respect to New York State's public health and health care delivery system. It is charged with adopting and amending the Sanitary Code and health care facility, home care agency, and hospice operating regulations. The PHHPC also makes decisions concerning the establishment and transfer of ownership of health care facilities, home care agencies and hospice programs. It makes recommendations to the Commissioner of Health concerning major construction projects, service changes, and equipment acquisitions in health care facilities and home care agencies. It also advises the Commissioner on issues related to the preservation and improvement of public health. The Council's powers and duties are set forth in section 225 of the Public Health Law.

COMMITTEE ON CODES, REGULATIONS AND LEGISLATION

Reviews new and revised regulations relating to medical facility operational and structural standards, including quality of care and the need for the facilities and/or services. Reviews amendments to the State Sanitary Code and other matters referred by the Commissioner. The Codes Committee will also include work of the SHRPC's Fiscal Policy Committee which was charged to review proposed changes to part 86 of the State Hospital Code concerning reimbursement rates for medical facilities.

The Committee will convene at 10:00 a.m.

COMMITTEE ON ESTABLISHMENT AND PROJECT REVIEW

Responsible for reviewing the CON applications involving construction, service changes, establishment, and transfers of ownership. Reviews the establishment of fundraisers, corporate name changes, and changes in certificates of incorporation.

The Committee will convene immediately following the Committee on Codes, Regulations and Legislation.

AD HOC COMMITTEE ON FREESTANDING AMBULATORY SURGERY CENTERS AND CHARITY CARE

The Committee is to examine the factors affecting the level of charity care being provided by freestanding ambulatory surgery centers (ASCs), including those that cause some ASC operators to fall significantly short of their charity care targets. The Committee is also to consider alternatives to the direct provision of charity care by freestanding ASCs which may nevertheless expand access to services by uninsured clients and others dependent on uncompensated care.

The Committee will convene immediately following the Committee on Establishment and Project Review.

Joint Meeting of the Public Health Committee and the Ad Hoc Committee to Lead the Prevention Agenda

The Public Health and Health Planning Council's Public Health Committee and its Ad Hoc Committee to Lead the Prevention Agenda will hold a joint meeting on Thursday January 29, 2015 from 10:30 a.m. - 12:30p.m.

At this meeting, the NYS DOH will provide findings from its review of the one year update on local community health improvement plans submitted by local health departments and hospitals in December 2014 and engage members of the committees in a discussion of how to move forward to support local efforts. An update on the State Health Innovation Plan will also be provided.
