Public Health and Health Planning Council

The Public Health and Health Planning Council (PHHPC) has a broad array of advisory and decision-making responsibilities with respect to New York State's public health and health care delivery system. It is charged with adopting and amending the Sanitary Code and health care facility, home care agency, and hospice operating regulations. The PHHPC also makes decisions concerning the establishment and transfer of ownership of health care facilities, home care agencies and hospice programs. It makes recommendations to the Commissioner of Health concerning major construction projects, service changes, and equipment acquisitions in health care facilities and home care agencies. It also advises the Commissioner on issues related to the preservation and improvement of public health. The Council's powers and duties are set forth in section 225 of the Public Health Law.

COMMITTEE ON HEALTH PLANNING

Advises the Council on need-methodologies, health facility plans, and emerging health care issues. Monitors major health care initiatives and advises the Council on progress and/or problems. The Committee will also include functions from the SHPRC's Committee on Major Medical Equipment and Appropriateness whose responsibilities were to develop and review appropriateness standards (Part 708) for various services. The Committee evaluates high technology equipment, and advises the Council on such specialized services as organ transplants. The Committee will also take into consideration matters relative to the collaboration with the Rural Health Council. The Committee will also handle matters that were considered under the SHPRC's Information Systems Review Committee whose general purpose was to advance a framework for CON to ensure interoperable health information technology is an underpinning to health care delivery and supports health care stakeholders. Advise the DOH on health information policy relevant to health care stakeholders.

COMMITTEE ON PUBLIC HEALTH

Charged with addressing the statewide governmental public health infrastructure (including workforce, IT, laboratory and other organizational capacity consistent with the Essential Public Health Functions) and support actions to assure readiness for future public health agency accreditation and public health workforce certification. It will also promote interagency collaborations across government to support a "Health in All Policies" approach by State leadership. These activities would be combined with the current Ad Hoc Prevention Committee of PHC.

COMMITTEE ON HEALTH PLANNING

The September 24, 2015 meeting of the Public Health and Health Planning Council's Committee on Health Planning will include a discussion of possible approaches to revision of the current need methodology for residential health care facility beds (Title 10, Section 709.3), which expires at the end of 2016. Nursing home operators, provider associations, consumers, long-term care advocacy groups, payers and other stakeholders are invited to comment on possible factors for consideration in the revision of section 709.3, including but not limited to:

  • Suitability of the 97% occupancy threshold
  • Planning areas:
    • County
    • Multi-County
    • NYC five boroughs
    • Long Island (Nassau-Suffolk)
    • Allow DSRIP arrangements – PPS service areas, etc.
  • Short stays of <100 days
    • Percentage of admissions
    • Impact on occupancy rates.

JOINT MEETING OF THE PUBLIC HEALTH COMMITTEE AND THE ADHOCCOMMITTEE TO LEAD THE PREVENTION AGENDA

The Public Health and Health Planning Council's Public Health Committee and its Ad Hoc Committee to Lead the Prevention Agenda will hold a joint meeting immediately following the Establishment and Project Review Committee meeting.

At the meeting we will provide a brief update on the Prevention Agenda objectives, discuss continued efforts to connect the Prevention Agenda with DSRIP and SIM as these health reforms are being implemented in local communities, review proposed updates to Prevention Agenda evidence based interventions, and discuss the next cycle of local community health planning.

AD HOC COMMITTEE ON FREESTANDING AMBULATORY SURGERY CENTERS AND CHARITY CARE

The Committee is to examine the factors affecting the level of charity care being provided by freestanding ambulatory surgery centers (ASCs), including those that cause some ASC operators to fall significantly short of their charity care targets. The Committee is also to consider alternatives to the direct provision of charity care by freestanding ASCs which may nevertheless expand access to services by uninsured clients and others dependent on uncompensated care.

Reviews new and revised regulations relating to medical facility operational and structural standards, including quality of care and the need for the facilities and/or services. Reviews amendments to the State Sanitary Code and other matters referred by the Commissioner. The Codes Committee will also include work of the SHRPC's Fiscal Policy Committee which was charged to review proposed changes to part 86 of the State Hospital Code concerning reimbursement rates for medical facilities.

Responsible for reviewing the CON applications involving construction, service changes, establishment, and transfers of ownership. Reviews the establishment of fundraisers, corporate name changes, and changes in certificates of incorporation.

The Committee will convene immediately following the Committee on Codes, Regulations and Legislation.

AD HOC COMMITTEE ON FREESTANDING AMBULATORY SURGERY CENTERS AND CHARITY CARE

The Committee is to examine the factors affecting the level of charity care being provided by freestanding ambulatory surgery centers (ASCs), including those that cause some ASC operators to fall significantly short of their charity care targets. The Committee is also to consider alternatives to the direct provision of charity care by freestanding ASCs which may nevertheless expand access to services by uninsured clients and others dependent on uncompensated care.

The Committee will convene immediately following the Committee on Establishment and Project Review.

Joint Meeting of the Public Health Committee and the Ad Hoc Committee to Lead the Prevention Agenda

The Public Health and Health Planning Council's Public Health Committee and its Ad Hoc Committee to Lead the Prevention Agenda will hold a joint meeting on Thursday January 29, 2015 from 10:30 a.m. - 12:30p.m.

At this meeting, the NYS DOH will provide findings from its review of the one year update on local community health improvement plans submitted by local health departments and hospitals in December 2014 and engage members of the committees in a discussion of how to move forward to support local efforts. An update on the State Health Innovation Plan will also be provided.
